DATA PROTECTION POLICY FOR USERS

In accordance with European Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), as well as Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPD-GDD), we inform you of our data protection policy for visitors and users of our website.

Both data privacy and information confidentiality are important aspects for SECE. This data protection policy establishes the way in which the personal data obtained from users through this website is processed and may vary over time due to possible legislative or jurisprudential changes or the criteria followed by the Spanish Data Protection Agency and/or the competent authority at any time. That is why SECE reserves the right to modify this policy to adapt it to new legislation or jurisprudence that are in force at the precise time the website is accessed.

2.- Purposes of the processing, legal basis and storage periods

At SECE we process the personal data of users of our website for the following purposes:

CONTACT REQUESTS:

  • We will use the contact details provided to respond to your requests and queries regarding our products and services, whether they are made through the form available on the website or addressed to the contact email addresses that are published.
  • The legal basis for the processing is the user’s consent based on a prior request for information that is deemed to have been granted with the acceptance of this policy.
  • The retention period: the data will be kept for the time necessary to respond to the request and maintain the commercial relationship.

SENDING COMMERCIAL COMMUNICATIONS:

  • SECE may process the data provided to send the user commercial communications. To this end, it will previously request your consent through an acceptance box provided for this purpose.

The User may revoke their consent at any time, communicating their desire not to receive any more commercial communications by following the instructions indicated in the footer of each of the commercial communications sent by SECE.

  • The legal basis for the processing is the consent that will be deemed to have been given at the time of accepting the box enabled for this purpose.
  • The storage period: the data will be kept indefinitely, as long as the user does not express their desire not to continue receiving information, in this regard in compliance with the Law on Information Society Services 34/2002 of 11 July, we inform the applicant that their authorisation allows us to send them the requested communications through telematic means and that this may be revoked at any time.

RECEIVING APPLICATIONS TO WORK AT SECE

  • The personal data of people who want to apply to work at SECE will be processed through the form provided for this purpose.
  • The legal basis for the processing is the user’s authorisation based on a prior request for information that is considered to have been granted with the acceptance of this policy, as well as that is necessary for the application of pre-contractual measures at the request of the interested party.
  • The retention period: the data will be kept for the time necessary to process the application.

INTERNAL INFORMATION SYSTEM (WHISTLEBLOWING CHANNEL):

  • SECE has implemented a Whistleblowing Channel in order to provide a safe and reliable internal channel where people who have relevant information about possible regulatory violations or corrupt acts can express themselves and provide their testimony in a responsible manner.
  • The legal basis for the processing is that it is necessary processing for compliance with a legal obligation applicable to the data controller as provided for in Article 30 of Law 2/2023, of 20 February, regulating the protection of persons who report regulatory breaches and the fight against corruption.
  • The storage period: As determined in Article 32 of the aforementioned law.

3.- Recipients of personal data

SECE will not disclose your data to third parties except by legal obligation, within the framework of a police investigation or at the request of judges and courts by court order.

4.- Rights of data subjects

Anyone has the right to obtain information about what data they are processing.

Here are your rights:

  • Data subjects have the right to access their personal data, as well as to request the rectification of inaccurate data or, where appropriate, to request its deletion when, among other reasons, the data is no longer necessary for the purposes for which they were collected.
  • In certain circumstances, data subjects may request the limitation of the processing of their data, in which case they will only be kept for the exercise or defence of claims.
  • In certain circumstances and for reasons related to their particular situation, the interested parties may object to the processing of their data. SECE will cease processing the data, except for compelling legitimate reasons, or the exercise or defence of possible claims.
  • Portability: The data subject will have the right to receive the personal data concerning him/her, which he/she has provided to the insurer, in a structured, commonly used and machine-readable format when: a) the processing is based on consent or a contract, and (b) the processing is carried out by automated means.

We inform you of your right to file a complaint with the supervisory authority (AEPD.- www.agpd.es) in the event that you have not been satisfied with the exercise of your rights indicated herein. To exercise the aforementioned rights, you can contact us by email LOPD@SECE.COM., from where you will be provided with the forms and the necessary instructions to process your request.

5.- Security in processing data

Taking into account the state of the art, the costs of implementation, and the nature, scope, context and purposes of the processing, as well as risks of varying likelihood and severity to the rights and freedoms of natural persons, SECE shall implement appropriate technical and organisational measures to ensure a level of security appropriate to the existing risk,  that prevent the accidental or unlawful destruction, loss or alteration of personal data transmitted, stored or otherwise processed, or the unauthorized communication or access to such data.
